These Terms of Service ("Terms") govern your access to and use of CallSteady's AI voice receptionist service ("Service") operated by CallSteady ("we," "us," or "our"). By using the Service, you agree to these Terms.

1. Service Description

CallSteady provides an AI-powered telephone answering service that handles inbound calls on behalf of your business. The Service may answer questions, take messages, book appointments, and route calls according to your configuration.

You must be at least 18 years old and capable of forming a binding contract to use this Service. By using CallSteady, you represent that you meet these requirements.

This is your responsibility. You must comply with all federal, state, and local laws regarding call recording and AI disclosure, including but not limited to:

CallSteady is not responsible for your compliance with recording laws. We recommend consulting legal counsel regarding your obligations.

5. Healthcare Use and HIPAA

If you use CallSteady in connection with healthcare services subject to HIPAA, you must execute a Business Associate Agreement (BAA) with us before handling any Protected Health Information (PHI). Using the Service to handle PHI without a signed BAA is a material breach of these Terms and may result in immediate account termination.

6. Subscription and Payment

Subscriptions are billed monthly. Your free trial period (7 days) begins at signup. You will not be charged during the trial. After the trial, your selected plan renews automatically each month until cancelled. All fees are non-refundable except as required by law. You may cancel at any time; cancellation takes effect at the end of the current billing period.

CallSteady's AI may make errors, misunderstand callers, or provide incomplete information. The AI does not provide medical, legal, financial, or emergency services advice. You must configure appropriate escalation protocols for urgent situations. CallSteady is not liable for missed calls, incorrect information provided by the AI, or any harm resulting from reliance on AI responses.

9. Emergency Situations

CallSteady's AI is not a substitute for emergency services. You must configure your account to immediately transfer calls involving emergencies to appropriate personnel or direct callers to dial 911. Failure to do so is a material violation of these Terms.

10. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We are not liable for downtime, interruptions, or service degradation.

11. Intellectual Property

CallSteady retains all rights to the Service, platform, and underlying technology. You retain ownership of your business information and call data. You grant us a limited license to use your data solely to provide the Service.

12. Limitation of Liability

To the maximum extent permitted by law, CallSteady's total liability for any claims arising from these Terms or your use of the Service shall not exceed the amounts paid by you in the three months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages.

You agree to indemnify and hold CallSteady harmless from claims arising from your use of the Service, violation of these Terms, or violation of any law or third-party rights.

14. Termination

Either party may terminate at any time. We may suspend or terminate your account immediately for violations of these Terms. Upon termination, your right to use the Service ends and your data will be deleted per our Privacy Policy.

15. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Disputes shall be resolved in the state or federal courts located in Ventura County, California.

16. Changes to Terms

We may modify these Terms with 30 days' notice for material changes. Continued use after the notice period constitutes acceptance.
